Canada’s new “Employer Portal”

On October 26, 2015, Citizenship and Immigration Canada (CIC) introduced a new electronic, online system to facilitate the processing of offers of employment from Canadian businesses to foreign workers. The program was designed to aid Canadian employers looking to hire temporary foreign workers through the Temporary Foreign Worker program or the International Mobility Program.

On October 26, 2015, Citizenship and Immigration Canada (CIC) introduced a new electronic, online system to facilitate the processing of offers of employment from Canadian businesses to foreign workers. The program was designed to aid Canadian employers looking to hire temporary foreign workers through the Temporary Foreign Worker program or the International Mobility Program.

Using the new system, employers now must submit offers of employment in Labour Market Impact Assessment-exempt situations directly to the CIC. The previous IMM 5802 Offer of Employment to a Foreign National Exempt from the Labour Market Impact Assessment form will no longer be accepted.

In the situation where an employer has already provided a completed IMM 5802 to a foreign worker, the worker should submit the application before November 21, 2015 for it to remain valid. If this deadline is not met, then the employer will have to resubmit the offer of employment, this time using the Employer Portal.

The introduction of the Employer Portal is the first step in Canada’s quest to move applications for immigration, temporary and permanent, to online systems. It follows changes made to the processing of LMIA-exempt work permits made earlier this year and signifies a new page in the book of Canadian immigration.
