PARTIES TO THE AGREEMENT:
(hereafter referred to as “CLIENT”)
AND
FWCANADA Inc., a federally registered corporation, with its head office at 6600 Boulevard Decarie, Suite 140, Montreal, Quebec H3X 2K4, represented herein by Attorney Marisa Feil
(hereafter referred to as “ATTORNEY”)
PREAMBLE:
CLIENT hereby agrees to retain ATTORNEY to provide legal counsel and representation for an Authorization to Return to Canada (ARC) application, and ATTORNEY agrees to provide such services, subject to the following terms and conditions (the “Agreement”):
1. ENGAGEMENT OF ATTORNEY
CLIENT agrees to engage ATTORNEY for the preparation and submission of an ARC application; these services shall be provided exclusively in Canada.
2. DUTIES OF ATTORNEY
ATTORNEY shall:
(i) Assess CLIENT’s eligibility and the nature of the removal order
(ii) Assist CLIENT in preparing all relevant forms and documentation
(iii) Advise CLIENT on supporting documents required, including proof of compelling need to return to Canada
(iv) Analyze and review supporting documentation and legal basis for application
(v) Draft a detailed legal submission letter addressed to the appropriate Canadian immigration authority
(vi) Conduct final review of the full ARC package, including forms, documents, and processing fees
(vii) Submit the application to the appropriate office and confirm receipt
(viii) Make further written and/or oral representations to Immigration, Refugees and Citizenship Canada (IRCC) or other relevant Canadian agencies as necessary
(ix) Use best efforts to secure approval of the ARC application, while acknowledging that success cannot be guaranteed
3. DUTIES OF CLIENT
CLIENT shall:
(i) Provide all information and documentation requested by ATTORNEY in a timely, honest, and accurate manner
(ii) Ensure, at CLIENT’s expense, that any non-English or non-French documents are translated by certified translators
(iii) Disclose all relevant facts including but not limited to: details of the removal order, prior inadmissibility, past refusals, or any criminal or immigration history
(iv) Ensure all communication with Canadian immigration officials goes through ATTORNEY and promptly notify ATTORNEY of any direct contact from IRCC
(v) Follow ATTORNEY’s reasonable guidance throughout the case
(vi) Pay ATTORNEY the fees set forth in Section 4; CLIENT agrees that services begin once fees are deposited and acknowledged in trust by ATTORNEY
4. ATTORNEY FEES
CLIENT agrees to pay the following non-refundable legal fees (the “Fees”):
- USD 2000 to FWCANADA INC. IN TRUST upon execution of this Agreement
Total Attorney Fees = USD 2000
These fees are non-refundable.
The CLIENT agrees that receipt of legal guides, instructions, emails, and/or consultations constitutes receipt of services.
This agreement is valid for one year (365 days) from the date of signing. If the services are not used during that time, additional fees may apply.
5. INTERPRETATION
(i) This Agreement shall be governed by the laws in force in the Province of Quebec, Canada.
(ii) Any reference to the singular shall include the plural and vice versa; gendered terms shall include all genders as appropriate.
(iii) This Agreement may be signed in counterparts and via electronic means, each of which shall be considered an original.
